Safina deputy party leader and lawyer Willis Otieno has called for sweeping reforms to policing and electoral systems, saying the 2010 Constitution has not delivered the expected changes in how the police operate.<\/p>\n\n\n\n

Otieno was speaking at Mama Grace Onyango Social Hall in Kisumu during a commemoration of the 16th anniversary of the Constitution.<\/p>\n\n\n\n

He said the occasion, dubbed Katiba@16, was a reminder that Kenyans had a responsibility to uphold and protect the sovereignty of the country.<\/p>\n\n\n\n

Otieno called on leaders, state institutions and citizens to ensure that sovereign power is exercised in accordance with the Constitution, particularly in protecting electoral integrity and transparency.<\/p>\n\n\n\n

“We must hand power back to the people,\u201d he said. Otieno said police brutality remained a major concern and accused officers of operating without adequate civilian oversight.<\/p>\n\n\n\n

He said the Constitution was intended to make the police more accountable to the public, but argued that the current command structure had left officers more responsive to directives from Nairobi than to the law.<\/p>\n\n\n\n

“We have seen police abducting residents. Police operating as goons, wearing balaclavas. We don’t know which authority they report to,\u201d he said.<\/p>\n\n\n\n

He also accused police officers of disobeying court orders and engaging in extrajudicial killings.<\/p>\n\n\n\n

Otieno proposed that every police station should have a civilian board made up of residents from the area it serves.<\/p>\n\n\n\n

The boards would oversee administrative aspects of policing, including inspecting cells, checking whether detainees had been taken to court within the required period and ensuring injured detainees received medical treatment.<\/p>\n\n\n\n

They would also examine the circumstances surrounding the use of firearms and establish whether officers had acted lawfully.<\/p>\n\n\n\n

Otieno compared the proposed boards with boards of management in schools and health facilities.<\/p>\n\n\n\n

He also proposed changes to the police command structure, including the election of sub-county police commanders by residents for five-year terms.<\/p>\n\n\n\n

Under his proposal, the commander could be either a police officer or a civilian, while other officers would continue to be appointed through the National Police Service Commission.<\/p>\n\n\n\n

Otieno said elected commanders would be less likely to obey unlawful orders from senior officials in Nairobi.<\/p>\n\n\n\n

“If anybody calls him from Nairobi to go and abduct Albert Ojwang in his police precinct, he will tell him, \u2018Who are you? That is my resident, I will apply the law,\u2019\u201d he said.<\/p>\n\n\n\n

He said the reforms were intended to make the police accountable to Kenyans rather than political leaders.<\/p>\n\n\n\n

Otieno also criticised the way presidential election results are tallied in Kenya, arguing that the Constitution places responsibility for presidential elections at constituency level.<\/p>\n\n\n\n

He said constituency returning officers should be responsible for presidential election results in their respective constituencies, while the chairperson of the electoral commission should calculate the overall result.<\/p>\n\n\n\n

Otieno argued that former electoral commission chairman Wafula Chebukati’s decision to designate himself as the returning officer for the presidential election was unconstitutional.<\/p>\n\n\n\n

“The chairperson’s role is purely to compute the outcome of the elections,\u201d he said.<\/p>\n\n\n\n

He argued that presidential elections should be conducted and announced at constituency level, with any challenge to a returning officer’s decision ultimately determined by the Supreme Court.<\/p>\n\n\n\n

At the Kisumu commemoration, Otieno also stressed the need to protect the power of the polling station as part of defending the sovereignty of the people.<\/p>\n\n\n\n

He said Kenyans should use the Constitution’s anniversary to demand greater public control over elections and other state institutions.<\/p>\n\n\n\n

Otieno criticised the Independent Electoral and Boundaries Commission over the timing of efforts to address defects identified by the courts in the electoral framework.<\/p>\n\n\n\n

He said the commission should have acted sooner to correct the problems.<\/p>\n\n\n\n

Oteino also called for greater transparency in the procurement and deployment of technology and services used during elections.<\/p>\n\n\n\n

He questioned the suitability of some foreign companies involved in providing electoral technology, alleging that some had questionable records in other countries.<\/p>\n\n\n\n

Otieno said political parties, election observers and the media should be allowed to monitor the selection of electoral technology providers.<\/p>\n\n\n\n

He cited Article 10 of the Constitution, which sets out principles including transparency and accountability in governance, Otieno called for an open procurement process to protect the sovereignty of Kenyan voters.<\/p>\n\n\n\n

“IEBC is bound by those provisions,\u201d he said. He said electoral reforms should ensure elections are transparent, accountable and controlled by the people rather than political or administrative interests.<\/p>\n\n\n\n

Otieno confirmed that Safina will participate in the 2027 general election. He said party leader Jimmy Wanjigi would be the party’s presidential candidate, with Otieno as his running mate, in accordance with the party’s constitution.<\/p>\n\n\n\n

“The Safina Party is going to participate in the elections,\u201d he said. \u201cOur party leader, Jimmy Wanjigi, is the presidential candidate as per our constitution. I am his running mate as per our constitution.\u201d<\/p>\n\n\n\n

Otieno said the Constitution’s anniversary was also an opportunity to engage young people in defending the country’s constitutional order.<\/p>\n\n\n\n

He welcomed the participation of youths at the Kisumu event, saying he was encouraged by their interest in the Constitution and their willingness to be part of efforts to bring about change.<\/p>\n\n\n\n

“I was very delighted to see so many youths join the conversation with assurance of being part of change and interest to protect and defend the Constitution,\u201d he said.<\/p>\n\n\n\n

He said the participation of young Kenyans was important to efforts to safeguard constitutional rights, electoral integrity and the sovereignty of the people.
